DMCA Policy

DMCA Policy

This Digital Millennium Copyright Act (DMCA) policy outlines the process by which copyright holders can request the removal of infringing content from our platform. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please follow the procedure outlined below to file a notice with us.

1. DMCA Notice Procedure

If you are a copyright owner or an authorized representative, and you believe that any content on our website infringes your copyrighted work, you may submit a DMCA notice to us. The notice must contain the following information:

  • Identification of the copyrighted work: Provide a description of the work that you claim is being infringed.
  • Identification of the infringing material: Provide a description of the material that you believe infringes your copyright, including the URL of the page where the material is located.
  • Your contact information: Include your name, address, phone number, and email address.
  • Statement of authority: A statement that you have a good faith belief that the material is being used without the authorization of the copyright owner, its agent, or the law.
  • Statement of accuracy: A statement that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  • Signature: Provide your physical or electronic signature.

Once we receive your DMCA notice, we will promptly remove or disable access to the infringing material as required by the DMCA. We will also notify the user who posted the material that we have received a complaint.

2. Counter-Notice Procedure

If you are the user whose content has been removed, and you believe that the content was removed as a result of mistake or misidentification, you may submit a counter-notice. A counter-notice must contain the following information:

  • Your contact information: Your name, address, phone number, and email address.
  • Identification of the material: A description of the material that was removed and the URL where it appeared before it was removed.
  • Statement of good faith: A statement under penalty of perjury that you believe the material was removed due to a mistake or misidentification.
  • Agreement to jurisdiction: A statement that you consent to the jurisdiction of the courts in [Your Jurisdiction], and that you will accept service of process from the person who submitted the DMCA notice.
  • Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notice, we will reinstate the content unless the copyright owner files a lawsuit to seek an injunction against the user. If we do not receive a copy of the complaint, we may be required to remove the content again.

3. Repeat Infringers

We may, in our sole discretion, terminate or suspend the accounts of users who are repeat infringers. We reserve the right to take appropriate action, including removing content and taking further legal action, to ensure compliance with the DMCA and to protect the rights of copyright owners.

4. Disclaimer

We are not liable for any damages resulting from the removal of content or suspension of accounts based on DMCA notices. We act in good faith to comply with the law, but we cannot guarantee that all claims of infringement are valid or that all actions taken in response to those claims are correct.
